Terms, privacy and refunds

Written to be read. If something here is unclear, ask us and we’ll fix the wording.

Terms of service

CueStudio is licensed, not sold. A licence gives you the right to run it on up to 3 Macs at a time for as long as that licence is active. You can move that entitlement between machines yourself, as often as you like. A licence is either a subscription, which renews until you cancel it, or a one-off purchase covering a fixed number of days from a date you choose, which does not renew at all.

You may use it commercially, including on paid productions, with no additional licence. You may not resell, sublicense, or redistribute the application itself.

Your show files are yours. They are plain document bundles containing your own media and cue data. They stay readable whether or not you keep subscribing, and nothing in them is locked to us.

When a subscription ends, the app keeps running to the end of the period you paid for plus a short buffer, so a late renewal cannot interrupt a performance. After that it stops until you renew. A one-off purchase ends the same way, on the last day it covers, with the same buffer; there is nothing to cancel, and buying another adds its days on top of whatever is left rather than replacing them.

Prices and tax. Australian customers are billed in Australian dollars, and the AUD price shown includes 10% GST: the figure on the pricing page is the whole amount charged. Everyone else is billed in US dollars, which exclude sales tax; sales outside Australia are GST-free exports. Nothing is added at checkout: the amount shown is the amount charged. Whether a sale is taxable is decided by the billing country you give at checkout. We issue a tax invoice for every payment ourselves; Stripe only takes the payment. Every invoice is available at any time from your account.

Liability. CueStudio is used in live performance and is built with that responsibility in mind, but no software is free of faults. Always have a plan for what happens if any part of your rig fails. That is why the redundancy features exist.

Nothing here takes away rights you already have. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law, and nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under that law, or under any other law, that cannot lawfully be excluded. If you are a consumer somewhere else, the same goes for whatever non-excludable rights your own law gives you.

Where our liability can lawfully be limited, it is limited to resupplying the subscription or paying the cost of having it resupplied. We are not liable for indirect or consequential loss, including lost profit, lost bookings or lost production time, and our total liability for any claim is capped at what you paid us in the twelve months before it arose.

Refunds and cancellation

Cancel a subscription any time from your account. There is no notice period and no phone call. You keep access until the end of the period you have already paid for. A one-off purchase has nothing to cancel — it simply ends on its last day.

If CueStudio does not do what this website says it does, tell us within 14 days of your first payment and we will refund it in full. We would rather return your money than have you stuck with software that does not fit your rig, which is also why the demo exists, and why the weekly plan is $19 rather than $599.

If you are a consumer in the EU or the UK you normally have 14 days to change your mind about a digital purchase. Where supply begins as soon as you pay — a subscription, or a one-off you have set to start immediately — you are asking us to begin supplying it straight away, and the statutory withdrawal right ends once supply has begun. The 14-day refund above is offered regardless and is more generous, so you are not worse off.

A one-off purchase set to start on a future date is different: supply has not begun, so nothing has been given up. Write to us any time before that date and we will refund it in full.

Renewals are not automatically refundable, but if one catches you by surprise (a season ended, a venue closed) write to us. We are a small operation and we would rather be reasonable than correct.

Refunds go back to the original payment method through Stripe, usually within five working days.

Third-party software and trademarks

CueStudio includes the NDI® SDK, the Syphon framework (© 2010–2011 Tom Butterworth & Anton Marini, Simplified BSD licence), and the Sparkle update framework (MIT licence). Full licence texts are in the app under About CueStudio 2 › Acknowledgements & Licences.

Privacy

What we hold, and why:

  • Your name: so support and invoices are addressed to a person rather than an address. You give it when you create the account, and it is not checked against anything.
  • Your email address: it is your account, and how we reach you about your licence.
  • Your subscription status: mirrored from Stripe so the app knows whether it can run.
  • A one-way hash of each licensed Mac’s serial number, its name, and when it last ran CueStudio. The hash lets us count seats and lets you tell your machines apart. We never receive the serial itself.
  • A one-way hash of the IP address used to sign in or send a support request, with a timestamp, so we can slow down automated abuse. There is no readable IP address in it, it is not tied to your account, and it is swept once it stops being useful.
  • A log of administrator actions. If one of us acts on your account, issuing a refund or freeing a seat, we record who did it, what they did and when, so the change can be traced.

We do not receive your card details. Payment is handled entirely by Stripe; we see only whether a subscription is active and when it renews.

Your shows never leave your machines. Cue lists, media and settings stay local. When you run two Macs in a session they talk directly to each other on your own network, and that traffic does not pass through us.

We do not sell your data, and we do not share it with anyone except the services needed to run the product: Stripe for payment, Supabase for accounts, and our email provider for the messages we send you.

Who holds it. Digital Lighting Solutions Pty Ltd is responsible for the information described here, and is the data controller for anyone in the EU or the UK.

Why we are allowed to hold it. Your email, subscription status and machine list are what we need to give you the thing you paid for: an account, a licence, and the seats it covers. The rate-limiting and administrator records rest on our legitimate interest in keeping accounts secure and automated abuse off the service.

How long we keep it. Account and licence records last as long as your account does. Payment records are kept for five years, which is what Australian tax law requires of us. Rate-limiting records are short-lived and are swept automatically. Administrator logs are kept while they remain useful for security and for settling disputes.

Where it goes. Accounts run on Supabase and payments on Stripe, so your data is processed on their systems, which may be outside Australia and outside the EEA. Both are bound by their own data protection terms. We do not send it anywhere else.

Your rights. Ask us for a copy of what we hold, or to correct it, delete it, stop using it, or hand it over in a portable form, and we will. If you are in the EU or the UK and think we have handled it badly, you can complain to your national data protection authority. In Australia, that is the Office of the Australian Information Commissioner.

Cookies. One first-party cookie, named cuestudio_session. It holds a session identifier so the site can keep you signed in, and nothing else. No analytics, no advertising and no third-party trackers, which is why there is no consent banner to dismiss.

On your Mac. Your licence token is stored in the macOS Keychain and contains the email address you subscribed with. It stays on the machine; the app sends it to us only to check that the subscription is still current.

Children. CueStudio is a professional tool and is not directed at children. We do not knowingly collect information from anyone under 16.

Ask us to export or delete your data at any time and we will do it. Deleting your account deactivates your licences, so do it after your last show rather than before.
